NORTHERN BASKETBALL LEAGUE (NBL) — WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK
This is an adult recreational league (18+). Play at your own risk.
By registering for and/or participating in the Northern Basketball League (“NBL”), including any games, practices, open gyms, meetings, events, or related activities (collectively, “Activities”), I acknowledge and agree as follows:
1) ADULT PARTICIPATION (18+)
I represent that I am 18 years of age or older and legally able to enter into this agreement.
2) ASSUMPTION OF RISK
I understand that basketball is a contact sport and that participation involves inherent risks, including but not limited to: falls, collisions, cuts, bruises, sprains, strains, dislocations, fractures, concussion, serious injury, paralysis, and death. I voluntarily choose to participate and assume all risks, known and unknown, foreseeable and unforeseeable, including risks arising from the actions or negligence of other participants.
3) VENUES / FACILITIES (SINGLE OR MULTIPLE LOCATIONS)
I understand that Activities may occur at one or more courts, gyms, schools, community centers, or other facilitiesselected by NBL now or in the future (“Venues”). I acknowledge that Venues may have conditions that present hazards (e.g., flooring, equipment, lighting, temperature, crowding, wet areas). I accept that NBL does not control all Venue conditions and I assume the risks associated with Venue conditions to the fullest extent permitted by law.
4) HEALTH & FITNESS
I affirm that I am physically able to participate. I am responsible for knowing my own medical condition, limitations, and preparedness. I agree to stop participating if I feel unsafe or unwell. I understand that NBL does not provide medical screening or medical supervision.
5) RELEASE OF LIABILITY
To the fullest extent permitted by law, I release and hold harmless Northern Basketball League, its organizers, volunteers, staff, sponsors, referees/officials, any host venue/facility and their owners/operators, and all related persons or entities (collectively, the “Released Parties”) from any and all claims, demands, damages, losses, costs, or causes of action of any kind arising out of or related to my participation in the Activities, including claims arising from the negligence of the Released Parties.
6) INDEMNIFICATION
I agree to indemnify and defend the Released Parties from and against any claim, demand, liability, loss, cost, or expense (including reasonable attorneys’ fees) arising from my participation in NBL Activities or my violation of league rules, facility rules, or this agreement.
7) RULES, CONDUCT, AND SAFETY
I agree to follow league rules, sportsmanship expectations, and all Venue policies. I understand that NBL may remove or suspend players for unsafe behavior, fighting, threats, harassment, intoxication, cheating, or unsportsmanlike conduct, at NBL’s discretion. I understand that removal may be without refund.
8) PROPERTY DAMAGE / PERSONAL PROPERTY
I am responsible for my personal belongings. To the fullest extent permitted by law, I release the Released Parties from liability for lost, stolen, or damaged personal property. I agree to be responsible for damage I cause to property or facilities.
9) EMERGENCY MEDICAL CARE
If I am injured, I authorize NBL and/or Venue staff to obtain emergency medical care for me. I understand I am responsible for all costs of medical care and transportation.
10) SEVERABILITY / GOVERNING LAW
This agreement is intended to be as broad and inclusive as permitted by applicable law. If any part is found invalid or unenforceable, the remainder will continue in full force. This agreement shall be governed by the laws of the State of New Mexico, to the extent applicable.
11) PHOTO, VIDEO & MEDIA RELEASE
I grant Northern Basketball League (“NBL”) and its authorized representatives the irrevocable right and permission to photograph, record, film, livestream, or otherwise capture my name, image, likeness, voice, and participation during any NBL Activities.
I understand and agree that such media may be used by NBL for legitimate league purposes, including but not limited to:
- League website and social media
- Promotional materials and marketing
- Sponsorship materials
- News, press releases, and advertising
- Archival and historical purposes
I waive any right to inspect or approve the finished product or the specific use to which it may be applied. I understand that I will not receive compensation for such use.
To the fullest extent permitted by law, I release and hold harmless NBL and its representatives from any claims arising out of or related to the use of such media.
12) REFUND POLICY
I understand and agree that all registration fees, league fees, and related payments are non-refundable, except as expressly provided herein.
No refunds shall be issued due to:
- Personal scheduling conflicts
- Voluntary withdrawal
- Injury or illness occurring after registration
- Suspension or removal for violation of league rules
- Dissatisfaction with team assignment or competitive level
In limited circumstances, and solely at the discretion of Northern Basketball League (“NBL”), a partial credit toward a future season may be issued in cases of documented medical incapacity occurring prior to the start of league play. Such credit, if granted, is not guaranteed and has no cash value.
If a participant fails to complete payment, their registration may be voided.
13) LEAGUE MODIFICATION OR CANCELLATION
I acknowledge that NBL reserves the right to modify, postpone, reschedule, relocate, or cancel any game, season, event, or activity due to circumstances including, but not limited to:
- Facility availability
- Insufficient team enrollment
- Weather
- Safety concerns
- Public health conditions
- Force majeure events
- Any condition deemed necessary by league organizers
If a full season is canceled prior to commencement, NBL may, at its sole discretion, issue a full or partial refund.
If a season is shortened, interrupted, or modified after commencement, refunds are not guaranteed and will be evaluated proportionally based on the number of games completed and league expenses incurred.
I agree that NBL shall not be liable for any indirect, consequential, or incidental damages arising from modification or cancellation of league activities.
14) DISCIPLINARY ACTION & CODE OF CONDUCT ENFORCEMENT
I understand that Northern Basketball League (“NBL”) is committed to maintaining a safe, competitive, and respectful environment for all participants, officials, staff, and spectators.
I agree to conduct myself in a sportsmanlike manner at all times and to comply with league rules, referee decisions, and facility policies.
Prohibited conduct includes, but is not limited to:
- Fighting or physical altercations
- Threats, intimidation, or harassment
- Verbal abuse toward referees, players, staff, or spectators
- Discriminatory or hateful language or behavior
- Unsportsmanlike conduct
- Property damage
- Any conduct that creates an unsafe environment
I acknowledge that NBL reserves the sole and absolute discretion to:
- Issue warnings
- Remove a participant from a game
- Suspend a participant for one or more games
- Remove a participant from the league
- Ban a participant from future seasons
Disciplinary decisions are final and not subject to appeal unless NBL expressly elects to review the matter.
I understand that removal or suspension due to misconduct does not entitle me to a refund of any fees paid.
15) SUBSTANCE USE & ALCOHOL POLICY
I understand that participation in NBL activities while under the influence of alcohol, illegal drugs, or impairing substances poses significant safety risks.
I agree that I will not:
- Participate in games or league activities while intoxicated or impaired
- Bring illegal drugs to league venues
- Consume alcohol or controlled substances in violation of facility rules
- Distribute alcohol or controlled substances to other participants
NBL reserves the right to remove any participant who appears impaired or whose behavior suggests intoxication or unsafe influence.
Such removal may result in suspension or permanent expulsion from the league at the sole discretion of NBL.
No refund will be issued in the event of removal due to substance-related misconduct.
16) ACKNOWLEDGMENT & AGREEMENT
By checking the box during registration, I confirm that I have read, understand, and agree to this Waiver, Release of Liability, and Assumption of Risk, and that I intend it to be legally binding.
